The Court determines the amount of the fine, taking into account, inter alia, and the financial capability of the Offender. If there is no provision in the Act regarding the maximum fine, then the fine is left to the discretion of the Court, which is exercised within the substantive jurisdiction and provided that the fine shall not be excessive.
